It all depends when someone applies for the labor, if you had BS+ 5 yrs exp and then did MS +4 yrs if you apply your labor now you can claim MS+9 again the experience at the current employer is not counted.....

1. An F2B petition can be converted and you will retain the original priority date as long as you do not marry before your father is granted citizenship.

As a California immigration lawyer who files many asylum cases, I am used to thinking of a the United States as a place of refuge and to documenting the horrible country conditions of other countries. I have successfully represented applicants for asylum who feared staying in their countries because while serving in their countries' armies, they were harmed on account of their sexual orientation.
It is therefore rather surprising to come across a story of a U.S.soldier who is fleeing to Canada (http://www.cbc.ca/canada/story/2009/11/20/refugee-board-soldier-lesbian.html) because she fears harm in the U.S. Army on account of her sexual orientation. According to CBC news, U.S. Army Pte. Bethany Smith fled Canada in September 2007 from a U.S. Army base in Fort Campbell, Ky. She applied for refugee status in October 2007, saying that she was harassed and threatened by fellow soldiers over her sexual orientation and feared that her life would be in danger if she were deported and returned to the army. The Canadian authorities initially rejected in her claim in February 2009. However, on appeal, the Federal Court of Canada held that the refugee board must reconsider the case again because the Board made several mistakes in initially reviewing her claim.
The Federal Court's decision (http://www.californiaimmigrationlawyerblog.com/Smith%20and%20the%20Minister%20of%20Citizenship%20 and%20Immigration.pdf)noted that the refugee board failed to fully consider the evidence pertaining to the situation of gays and lesbians in the U.S. Army to determine whether Pte. Smith could have availed herself of protection in the United States. The Federal Court also noted that the Board failed to determine whether Pte. Smith would be persecuted on account of her social group - as a lesbian in the U.S. Army if forced to return. There were other errors mentioned in the decision.
It is sad that the U.S. policy of "Don't Ask, Don't Tell," is the basis of an asylum claim in Canada. Pt. Smith was only 19 years old when she fled to Canada. From everything I read, it appears that she wanted to serve in the U.S. Army and no real desire to leave the United States. At a time when we apparently need people to serve in the Armed Forces and in fact give non-citizens a way to immigrate to the United States faster for their service, it seems ridiculous that an American citizen should have to leave. It it is time to eliminate the "Don't Ask, Don't Tell" policy.

Hello All,
Need you guys expert advise on a problem that I have just found.
I was on L1 since 2007 and in 2008 got my H1B visa done. Since I was in the US during september and october 2008, I changed my company who held my H1B as of 1st October,2008. I dont have an H1B stamp on my passport as I have not been out of the US.
It was only yesterday that I realised I had a I-797B approval notice, which from what I read yesterday, means that I have a petition approved but without I-94.
Now my L1 I-94 on my passport is valid till November 2010.
Need your help to understand if I have an issue here for the fact that I have worked with my employer who holds my H1B for the past 9 months.
If so what are the challenges that I have and the solutions for them.
Also has anyone been in the same situation.

I posted this question on another thread but its on page 38-39, so thought I might post as a new thread so that I can get some answer to my concerns...
I renewed my EAD thru e-filing. Everything was ok but the address to send the Confirmation Receipt is TSC. My initial I-485 is at NSC. My address did not change anytime from the time I applied I-485.
I entered the correct info in question 11..which was:
Have you ever before applied for employment auth. form USCIS?
X Yes(if yes, continue below)
I checked yes
which USCIS office?
My answer:
LINCOLN, NE date: 08/14/2007
Should I be worried about this or can I just feel its okay?

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.

I was married in India as per Muslim law and currently both of us hold US citizenship. At the time of marriage we both were indian citizens. What kind of rights do my wife has on my property in India on our divorce (I bought these properties after my marriage and it is all registered under my name) ? In US, both husband and wife would share any property that we aquired after the marriage. Does the same true in India?

Well , the law states that the property accumulated after marriage has to be divided. Did you buy that property in India with money you accumulated in the US? Did you transfer that money from US to India? Was that money accumulated after marriage? If yes, then it will be divided as well. Of course it's best to check with lawyer first.

Vonage, a provider of voice over Internet protocol phone service, has reached a settlement with Kentucky, Indiana and 30 other states over allegations of deceptive marketing and unscrupulous customer service procedures.
Under the agreement, Vonage will make �significant� changes to its marketing practices and handling of consumer cancellation requests. It also will provide refunds to eligible customers.
The company will pay the states a total of $3 million for reimbursement of legal and investigative costs. Kentucky�s portion of the reimbursement is $45,000, according to a news release from Kentucky Attorney General Jack Conway�s office.
Vonage officials could not immediately be reached for comment.
Vonage was ordered to provide refunds to customers who did not receive rebates they believed they were due because their accounts weren�t open long enough to qualify or because they spent a portion of their trial periods waiting to receive or return equipment.
Refunds also will be provided to customers who were assessed excess usage charges without being informed of usage limits, received additional monthly service charges because of difficulty in canceling service, or received charges for unordered services and equipment offered as free.
Under the settlement, Holmdel, N.J.-based Vonage (NYSE: VG) must revise its disclosures for offers of free services, money-back guarantees and trial periods, according to the release. The company also must follow strict guidelines in dealing with customers wishing to cancel their service.
Through their investigation, the states found that Vonage paid bonuses to customer service representatives who retained customers. As a result, many customers had difficulty canceling their service.
Now, Vonage must record and verify conversations between customers and the company�s customer service representatives, according to the release.

My husband applied EB2 in 2007. 140 approved and 485 pending. But then we came back to our home country because of layoff. We carried AP but now AP is expiring in 3 weeks. I know after AP goes expired, our 485 will be considered abandoned.
I heard that PD is still ours even in the case of abandonment of 485. So, I still hope that some day we can come back to US to re-do the green card application. My question is, once PD becomes current, how long will the window to submit 485 be open for us?

In order to preserve the PD, you will require a copy of your approved 140. Do you have the copy - in that case, next time you will have to file labor and at 140 stage, you can get your PD back.

yeah mike ,
you should use Swift 3D for the initial 3D rendering and animation . its also good to import that animation and any other animations to Flash itself. oh yeah and also you can customize how many times you wish for the animation to loop.

I am currently working with Comapany A with valid I-94 till 09/30/2011(but no visa stamping in passport yet).
Recently My H1B visa tranfer approved with out 1-94 card attached to approval copy(still I am with Company A only)
In this case can I continue with CompanyA.
